Broker License Information

A Real Estate Broker is any person, firm, limited liability company or corporation, who, for another and for a fee, commission or other valuable consideration, lists for sale, sells, at auction or otherwise, exchanges, buys or rents, or offers or attempts to negotiate a sale, at auction or otherwise, exchange, purchase or rental of an estate or interest in real estate, or collects or offers or attempts to collect rent for the use of real estate, or negotiates or offers or attempts to negotiate, a loan secured or to be secured by a mortgage, other than a residential mortgage loan, as defined in §590 of the Banking Law, or other incumbrance upon or transfer of real estate, or is engaged in the business of a tenant relocator, or who, notwithstanding any other provision of law, performs any of the above stated functions with respect to the resale of condominium property originally sold pursuant to the provisions of the General Business Law governing real estate syndication offerings. It is the responsibility of licensees to understand the Real Estate License Law.

The term of licensure is two years.

  • $10 – Change of Personal Name and/or Address (No fee is required if the name change is the result of a change in marital status)
  • $10 – Duplicate License/Registration Request
  • $0 – Termination of Association
  • $20 – Change of Association
  • $10 – Change of Branch Office
  • $10 – Change of Principal Office Address plus $10 for each license associated with office
  • $10 – Change of Branch Address plus $10 for each license associated with office

REQUIREMENTS

To be eligible for a career as a licensed broker, an individual must:

  • Be at least 20 years old.
  • Hold a NYS Driver’s License or Non-Driver ID featuring a photo.
  • Be a citizen of the United States or hold legal, permanent residency.
  • Maintain a clean record with no felony convictions (with potential exceptions).
  • Have at least two years of experience as a licensed real estate salesperson or at least three years of experience in the general real estate field or a combination of both
  • Meet the minimum points required for the experience type (e.g., buying and selling your own property, managing property owned by your employer)
  • Have satisfactorily completed 152 hours of approved qualifying education.
  • Pass a qualifying examination administered by the Department of State.
  • Submit a completed application and the required fee to the Department of State.
  • Submit of a signed student affidavit.
  • Prior to filing this application, all proposed business names must be submitted, in writing, to the Division of Licensing Services for approval.
  • Upon approval of the name you wish to use, you must then file the appropriate document with either the respective County Clerk’s office or the NYS Department of State, Division of Corporations.

To be eligible for a career as a licensed broker, an individual must:

In July 2008, the Department of State changed the sales course hourly requirement from 45 hours to 75 hours. Those already licensed before July 2008, who are now going for their broker license are responsible for taking the new additional 30 hours from the salesperson’s class.

You can always retake the Brokers exam the next time it is offered. You have three attempts to pass the exam during your four months. A $25.00 fee will be assessed after the third attempt.

You will receive a certificate of completion. Save this certificate, as it proves you’ve completed all coursework. The State Department may or may not ask you to mail it in to them at some point. If you haven’t done so already, you must obtain an eAccess account on the New York Department of State website. This account will allow you to register for your state exam.

Yes, you can take both the New York state and school Brokers exam in any order you like, but you must successfully pass both exams in order to apply for your brokers’ license.

RESNYS does not administer the Brokers State Exam. You must go to your local Department of State to take the exam. The cost for the exam is $15.00. You must register for the state exam through your eAccess account.

Congratulations! You now must apply for your Brokers license. The cost to apply for your Brokers license is $155.00. Once you receive it, you can start working as a Broker immediately.
